Internal Rules
For trainees of the PCSoft training centre (PC SOFT INFORMATIQUE SAS) — in-person and remote training courses
French Law No. 2018-771 of 5 September 2018 on the freedom to choose one's professional future, and Decree No. 2019-1143 of 7 November 2019.
Article 1 — Purpose and scope
These rules are established in accordance with Articles L. 6352-3, L. 6352-4 and R. 6352-1 to R. 6352-15 of the French Labour Code (Code du travail).
They apply to all trainees for the entire duration of the training course attended. They also apply to certification candidates during assessment sessions.
These rules apply to training delivered on the premises of the PCSoft training centre (Le Pecq) as well as to remote training. In the latter case, trainees are required in particular to keep their webcam on throughout the training and to respect the schedule and the half-day attendance sign-in.
They cover all training-related time: training sessions, breaks, meals organised by the training centre, assessment sessions, and exchanges conducted through remote training tools (virtual classroom, chat, forum, messaging, collaborative tools).
The purpose of these rules is to ensure the smooth running of the PCSoft training centre, taking into account both trainees and the centre. They set out an individual and collective framework essential to the conduct of training and to life in the community. To this end:
- They specify the obligations of trainees during the training course;
- They lay down the provisions relating to discipline and the safeguards attached to their implementation.
Article 2 — Discipline
Trainees are strictly prohibited, under penalty of sanctions, from:
- Bringing in or consuming alcoholic beverages or narcotics, or being intoxicated on the training centre premises;
- Eating in the classrooms;
- Smoking or vaping on the training centre premises;
- Entering the premises outside training hours, or bringing in or causing to be brought in any outside person;
- Recording or filming training sessions, unless expressly authorised (keeping messages or screenshots for the purpose of a report under Article 2 bis is not covered by this prohibition);
- Changing the settings of the computers provided;
- Connecting any equipment to the training centre's machines or network without the trainer's prior approval;
- Wearing clothing incompatible with health and safety rules;
- Bringing an animal onto the premises, with the exception of guide and assistance dogs;
- Organising or taking part in meetings at the training centre without the Management's approval;
- Bringing in objects or goods intended for resale to other trainees;
- Committing any act likely to compromise safety, disturb good order and discipline, or show disrespect towards others;
- Insulting or threatening members of staff or other trainees;
- Committing any of the acts referred to in Article 2 bis;
- Putting up notices or posters of any kind;
- Refusing to comply with health and safety instructions.
Article 2 bis — Violence, harassment and discrimination
The following are prohibited and liable to the sanctions provided for in Article 3, whether committed on the premises, during breaks and meals organised by the training centre, through remote training tools (virtual classroom, chat, forum, messaging) or during certification assessment sessions:
- Any physical or verbal violence, threat or intimidation;
- Sexist and sexual violence, in particular sexist conduct (Article L. 1142-2-1 of the Labour Code), sexist or sexual insult (Article R. 625-8-3 of the French Criminal Code; Article 222-33-1-1 for its aggravated form) and sexual harassment (Articles L. 1153-1 et seq. of the Labour Code; Article 222-33 of the Criminal Code);
- Moral (psychological) harassment (Articles L. 1152-1 et seq. of the Labour Code; Articles 222-33-2 and 222-33-2-2 of the Criminal Code);
- Any discrimination based on one of the criteria set out in Article L. 1132-1 of the Labour Code and Articles 225-1 and 225-2 of the Criminal Code;
- Any retaliation against a person who has reported facts in good faith or testified about them.
Any deliberately false report is also liable to sanction.
Any person who is a victim of or witness to such acts may contact PCSoft's referent for sexist and sexual violence, harassment and discrimination (HR Director or management) by e-mail at referent-vss@pcsoft.com. This address is provided with the course invitation and displayed in the training room and in the online area. Reports are handled in accordance with the "Procedure for the prevention and handling of violence, harassment and discrimination", which is available to trainees. The confidentiality of exchanges is guaranteed within the limits necessary for handling the report.
Filing a criminal complaint remains the victim's right, independently of the internal procedure. In case of immediate danger, call 17 or 112.
Article 3 — Sanctions
Any conduct considered as misconduct by the PCSoft training centre may, depending on its nature and seriousness, result in one of the following sanctions, in increasing order of severity:
- Written warning from the Director of the training centre;
- Temporary or permanent exclusion from the training course.
No sanction may be imposed on a trainee without the trainee being informed, at the same time and in writing, of the grounds held against them.
When the training centre is considering a sanction, it summons the trainee by letter handed over against a signed receipt, stating the purpose of the summons and the date, time and place of the interview, unless the sanction considered has no effect on the trainee's attendance for the remainder of the course.
During the interview, the trainee may be assisted by a person of their choice, either a trainee or an employee of the training centre.
During the interview, the reason for the sanction considered is stated to the trainee, who may then give any explanation or justification of the facts alleged.
The sanction may not be imposed less than one clear day or more than fifteen days after the interview. It is the subject of a written, reasoned decision notified to the trainee.
Where the conduct has made an immediate temporary precautionary exclusion necessary, no final sanction relating to that conduct may be taken without the procedure described in this article having been followed.
The training organisation concurrently informs the employer and, where applicable, the joint body or funder covering the training costs, of the sanction taken.
Article 4 — Loss, theft or damage of personal belongings
PCSoft accepts no liability for the loss, theft or damage of personal belongings of any kind left by trainees on the training centre premises.
Article 5 — Health and safety
The prevention of accidents and illness is imperative and requires everyone to comply fully with all applicable health and safety requirements.
To this end, the general and specific safety instructions in force within the organisation, where they exist, must be strictly observed under penalty of sanctions (see Article 3).
When training takes place at an off-site location, the applicable general and specific safety instructions and internal rules are those of the host organisation and of the training centre.
Anyone present on the training centre premises must read and apply the safety instructions displayed on the general information boards.
All trainees must use all individual and collective protective equipment provided to prevent accidents and strictly follow the instructions given for this purpose.
Any trainee with reasonable grounds to believe that a situation presents a serious and imminent danger to their life or health has the right to leave the premises. However, this right must be exercised in such a way that it does not create a new situation of serious and imminent risk for others.
The trainee must immediately report to the trainer any situation they consider dangerous. Any trainee who notices a failure or anomaly in the facilities or the operation of equipment must inform the trainer or the training centre manager.
Any incident, however minor, must be reported immediately to the Management by the victim or the witness (see Article 8). Acts of violence, harassment or discrimination are reported in accordance with Article 2 bis.
A video surveillance system is or may be active inside the premises.
Article 6 — Meals
Lunches (free of charge but optional) are taken together in restaurants near the training centre. The provisions of Article 2 bis apply during these meals.
Trainees following a special diet (allergy, food intolerance, etc.) may say so (the restaurant will try to accommodate them as far as possible).
Article 7 — Organisation and monitoring of training
Training courses are accessible to people with disabilities, and the adjustments initially agreed upon are monitored throughout the trainee's course.
The premises are also accessible to people with disabilities, with the following facilities: lift, access ramp.
Registration for a training course becomes final when the trainee:
- Has signed their training contract (purchase order and/or training agreement);
- Has paid any registration fees attached to the course and is up to date with payment of the corresponding tuition fees.
Trainees must attend all classes, assessments, practical work and, more generally, all sessions scheduled by the training centre, diligently and without interruption.
Please note that days of absence will be invoiced to the trainee. Attendance sheets are signed by trainees for each half-day. Except in cases of force majeure, the schedule must be strictly respected. Trainees must notify the training centre of any absence, late arrival or early departure.
The teaching methods, documentation and software provided are protected by copyright and may only be reused for strictly personal purposes. Any copying is expressly prohibited.
Trainees must, in general, keep in good condition all equipment made available to them during the training course. They must not use this equipment for purposes other than those intended for the course, in particular for personal purposes, without authorisation.
Article 8 — Sick leave or work accident
Any absence due to illness must be justified by a sick note issued by a doctor (submit a photocopy of the "employer" copy to the training centre, the original being sent to the employer or to France Travail) and sent to the training centre within 48 hours.
The trainee must notify the centre's Management from the first half-day of absence. Otherwise, the trainee is considered to be irregularly absent, with all the consequences this entails.
Any bodily injury, however serious, must be immediately brought to the attention of the training centre's Management so that the legal declarations can be made within the prescribed time limits.
The training centre has taken out civil liability insurance with Albingia (policy No. RC2505298) covering the trainee, PCSoft staff and the training centre facilities.
Article 9 — Trainee representation
In accordance with Articles R. 6352-9 to R. 6352-15 of the Labour Code, the election of a full and a substitute trainee representative is only mandatory for training courses lasting more than five hundred hours in total.
As the courses delivered by the PCSoft training centre are shorter than this threshold, no election of trainee representatives is organised.
For any course reaching this duration, the training centre would organise the election no earlier than twenty hours and no later than forty hours after the start of the course. If it proved impossible to establish this representation, a report of non-representation (procès-verbal de carence) would be drawn up and sent to the competent administrative authority. The representatives thus appointed would present any individual or collective complaint relating to the training, health and safety conditions and the application of these rules.
Article 10 — Distribution and publication of the rules
A copy of these internal rules is given to each trainee before final registration. It is appended to the training agreement or contract and to the invitation sent to the trainee, and is available to them throughout the training course.
For in-person training, the rules are also displayed or made available on the training centre premises. For remote training, they are accessible from the course's online area.
